On October 18, 1993, by act of City Council, the approximately seven-acre parcel
surrounding the Timberlake-Branham House designated as tax map 56, parcel 40.4 (the
"Parent Parcel") was zoned a individually protected property (an "IPP") under the City's
"Historical Preservation and Architectural Design Control Overlay District." The practical
effect of this action was that any construction, restoration or alteration of structures on
the Parent Parcel or any future subdivisions thereof required a hearing before the Board
of Architecture Review (the "BAR") and a certificate of appropriateness from the BAR,
or on appeal, by City Council.
City residents generally, and neighbors in particular, are thus afforded by this IPP
zoning a procedural safeguard by which any proposed development is scrutinized to
ensure its appropriateness given the historical character of IPP-zoned properties.
Between 1993 and 2006, the owners of the Parent Parcel made several
subdivisions and boundary adjustments which ultimately resulted in four parcels.
Notwithstanding these subdivisions and boundary adjustments, from 1993 until early
2007, the City's tax maps continued to list the entire Parent Parcel as 56-40.4. (see
Exhibit A).
Moreover, from 1993 until early 2007, all of the City's official maps showing the
IPP zoned parcels continued to show the area of the entire Parent Parcel as retaining IPP
status (see Exhibit B).
